Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Playlytix mobile application (the “App”) operated by Hoss Digital LLC (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent that you meet this minimum age requirement. If you are under 18, you should review these Terms with a parent or guardian. Users acting on behalf of a team, school, or organization represent that they have authority to bind that organization to these Terms.

2. Account Registration

To access most features of the App, you must create an account using a valid email address. You agree to:

  • Provide accurate and complete registration information
  • Keep your password secure and confidential
  • Notify us immediately of unauthorized account access
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Acceptable Use

You agree not to use the App to:

  • Upload false, misleading, or defamatory content about players, coaches, or teams
  • Harass, bully, or harm other users
  • Impersonate another person or organization
  • Collect or harvest personal data of other users without consent
  • Interfere with or disrupt the App's servers or infrastructure
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the App for any unlawful purpose
  • Violate any applicable laws or regulations

4. Team Data and User-Generated Content

Your Data

You own the team, player, and game data you create in the App (“Your Content”). You grant us a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of providing the App's features to you and your team members.

Your Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of Your Content. We do not review or endorse user-generated content. You represent that you have the right to enter and share any player information you input, including any necessary parental consent for minor players.

Content Standards

Your Content must not contain material that is illegal, offensive, or in violation of any third party's rights. We reserve the right to remove content that violates these Terms without notice.

5. Subscription and Paid Features

Free Tier

Playlytix offers a free tier with core functionality. Specific features may be limited on the free tier.

Subscription Plans

We offer optional paid subscription plans that unlock additional features. Pricing, included features, and billing cycles are described within the App at the time of purchase. All prices are displayed in US dollars unless otherwise noted.

In-App Purchases and Billing

Subscriptions are processed through the Apple App Store (iOS) or Google Play Store (Android). By subscribing, you authorize the applicable app store to charge your payment method on the applicable billing cycle. Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods except where required by applicable law.

Price Changes

We may change subscription pricing at any time. For active subscribers, price changes take effect at the next renewal. We will provide advance notice of price changes.

6. Intellectual Property

The App, including its design, code, trademarks, logos, and content (excluding Your Content), is owned by Hoss Digital LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

The App uses Firebase (Google) for data storage and authentication. Your use of those services is subject to Google's terms and policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Stat accuracy depends on timely and correct user input. We make no warranty regarding the accuracy of statistics recorded through the App.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOSS DIGITAL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hoss Digital LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, Your Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account and access to the App at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new effective date and, where appropriate, by in-app notification or email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
